Drunk Driving Accidents
The number of accidents caused by drivers
who have had too much alcohol to drink have decreased, as the public has
become aware of the dangers of driving while intoxicated. However there
are far too many accidents caused by drunk drivers even though the
number of incidents have decreased.
Our firm has a former Assistant District
Attorney who was on the DWI Task Force and was responsible for the
prosecution of 100's of individuals who were charged with driving while
intoxicated. Furthermore, our firm has lawyer that previously
represented insurance companies and their insureds.
Driving While Intoxicated is committed
when an individual drives or operates a motor vehicle with a blood alcohol
concentration of .08 or more; or, when an individual drives or operates
a motor vehicle when they have lost the normal use of their mental or
physical faculties. The thresh-hold is lowered below .08 for minors and
operators of trucks with commercial driver's licenses.
Experts have testified numerous times in
DWI cases that an average 150 lbs. person's alcohol concentration goes
up .02 for each drink consumed. A drink being defined as one glass of
wine, one 12 oz. beer or one cocktail with 1 oz. of liquor. The flip
side is that a person's alcohol concentration goes down .02 per hour.
Therefore, if a 150 lb. person has 5 drinks in one hour he/she should
have approximately a .08 blood alcohol concentration; or, a 150 lb.
person that has 6 drinks in two hours should also have a .08 blood
alcohol concentration. This is based on an average person. Many factors
can alter this formula, such as: how much food the subject had eaten;
the weight of the subject and how quickly the drinks were consumed.
